1. Introduction and Acceptance
By accessing the Bismillah's Meat Shop website (the "Site"), creating an account, or placing an order, you agree to these Terms and Conditions ("Terms") and our Privacy Policy. If you do not agree, please do not use the Site or place orders. We may update these Terms at any time, with changes posted on the Site; continued use after updates means you accept them.
2. Use of the Site
You must be at least 18 years old to place an order, or, if under 18, have parental consent. You agree to provide accurate and complete information during registration or checkout and to keep account credentials confidential. Using the Site for unlawful purposes or unauthorized access is prohibited. We may suspend or terminate accounts for misuse.
3. Products and Descriptions
All products are premium halal-certified fresh and frozen meat and BBQ items, prepared to meet strict halal and food safety standards. Product descriptions, images, and prices are for reference and may vary slightly due to the nature of fresh and frozen goods. We aim for accuracy but are not responsible for minor differences. If a product is unavailable, we may offer a similar substitute or cancel the order with a full refund, contacting you promptly.
4. Pricing and Payment
Prices are in Hong Kong Dollars (HKD) and exclude delivery or pickup fees, shown at checkout. No GST applies to food items. We currently accept payments via FPS or cash (for in-store pickup or cash-on-delivery). Payments, including a 50% deposit for BBQ orders (see Section 7), are processed when the order is confirmed, and you authorize us to charge the total amount via FPS or collect cash upon delivery/pickup. Prices may change, but confirmed orders keep the quoted price.
5. Orders and Order Confirmation
Orders are not binding until we send a confirmation email or message. We may refuse or cancel orders due to suspected fraud, pricing errors, or stock issues, with prompt notification and a full refund if we cancel. All orders are final once confirmed, and cancellations are not allowed except as noted in Section 7, due to the perishable nature of fresh products and quality requirements for frozen items.
6. Fresh and Frozen Meat and BBQ Policy
Each order of fresh and frozen meat and BBQ products is carefully prepared to your specifications, meeting halal and hygiene standards. Due to health and safety risks for fresh items and quality standards for frozen items, all sales are final. We do not accept returns, exchanges, or refunds for fresh items once an order is confirmed, except for defective goods as noted in Section 9. For frozen items, returns may be considered only if the product is defective (e.g., improperly frozen) and reported within the inspection period (Section 9). Please check your order carefully before confirming.
7. BBQ Order Requirements
BBQ orders need three (3) days’ advance notice to source fresh or frozen ingredients and prepare properly. For large orders, contact us earlier to ensure availability. Orders with less notice may be declined due to scheduling. A 50% non-refundable deposit is required at booking via FPS to secure your order, with the remaining balance due in FPS or cash upon delivery or pickup. BBQ orders are final once processing starts, with no cancellations, returns, or refunds. Deposits are forfeited if you cancel.
8. Shipping and Delivery
We deliver within Hong Kong (Hong Kong Island, Kowloon, New Territories, and select outlying islands) using our in-house delivery team. Orders placed before 3 PM are delivered same-day within 24 hours; orders placed after 3 PM are delivered the next day within 24 hours, subject to operational constraints. Delivery times may vary due to traffic, weather (e.g., typhoons), or other issues beyond our control. We are not responsible for such delays. Risk of loss transfers to you upon delivery. Track your order via the confirmation email or by contacting us. Click & Collect is available at our [insert shop address] during business hours; orders not collected within 48 hours may be cancelled without refund.
9. Inspection Upon Receipt
Check products immediately upon delivery or pickup. If fresh or frozen items are damaged, spoiled, improperly frozen, or incorrect, contact us within 24 hours via +852 5928 5678 with photos for review. We may offer a replacement or refund for defective goods at our discretion, where required by law. Failure to report within 24 hours voids claims. All sales remain final unless otherwise required. 10. Limited Warranty and Disclaimers
Products are warranted to be halal-certified, fresh or properly frozen at dispatch under normal handling. This is limited to replacement or refund for defective goods, as required by law. Products are provided "as is" without other warranties, express or implied, except where legally mandated. We are not liable for indirect or consequential damages (e.g., spoilage after delivery).
11. Limitation of Liability
Our liability is capped at the purchase price of the product, to the extent allowed by law. We are not responsible for indirect, special, or punitive damages from Site use or purchases.
12. Force Majeure
We are not liable for delays or failures due to events beyond our control, including supply chain issues, typhoons, pandemics, or government restrictions.
13. Privacy and Data Protection
